Stripey Stork Terms & Conditions of Sale

The following terms and conditions apply to all orders for the purchase of products from the Stripey Stork online shop. Please note, some of the conditions in this policy do not apply to our seasonal Santa Shop, as physical products are not actually being purchased, instead the donor is pledging money for us to purchase a Christmas gift for a child in need.

Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms or require any changes, please contact us to discuss.

If you are placing in order from outside the UK please note that these terms are subject to the laws of England and Wales and are subject to the exclusive jurisdiction of the English Courts.

Who we are: We are Stripey Stork a charity registered in England and Wales (number 1161613). Our registered office is at 51a Albert Road North, Reigate, Surrey RH2 9EL. In these terms we will also refer to Stripey Stork as “us” or “we“.

How to contact us: You can contact us by emailing us at info@stripeystork.org. If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order. “Writing” includes emails and when we use the words “writing” or “written” in these terms, this includes emails.

If you place an order online to purchase a product from Stripey Stork we will send you an email confirming receipt of your order and containing the details of your order.

Your order represents an offer to us to purchase a product which is accepted by us when we deliver the product to you. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

You warrant that you are legally capable of entering into binding contracts and that you are at least 18 years old.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system, however, the images of the products on our website are for illustrative purposes only.

In the event that there is an error in the pricing or description of products on our website, we reserve the right to refuse orders where product information has been mispublished, including prices and promotions.

The supply of products from this website is subject to availability and it is not always possible for us to inform you at the time you place your order whether the products you want are still available for purchase. In the case of this happening a carefully selected alternative may be sent, or a refund may be given.

The price of the products will be the price indicated on the website when you placed your order. All prices are in pounds sterling. We use our best efforts to ensure that the price of the product advised to you is correct. However please see below for what happens if we discover an error in the price of the product you order.

It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order.

If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any products provided to you.

Options for payment are either via PayPal or Stripe (for debit and credit cards).

If you choose Stripe to complete your purchase, they will store your debit/credit card data, but only as long as is necessary to complete the transaction. After your transaction is complete, your purchase transaction information is deleted (unless you selected the option to store payment information to your account for future purchases).

Payment shall be made in full at the time of you placing your order and we will not dispatch the products until we have received full payment for the products.

All payments are to be made in pounds sterling.

We aim to dispatch the products within three working days of your order being accepted by us, however, during busy periods/school holidays, it may take longer to process your order.

If you require your items to be delivered by a certain date, then please email info@stripeystork.org.uk and we will endeavour to arrange this, but cannot guarantee receipt of the products by a particular date as we use third party delivery services and is therefore outside of our control (please note that an extra cost may apply in these circumstances).

We dispatch the products by using Royal Mail 1st class for UK deliveries and it is estimated that products will be received within 7 days of posting by us).

We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

Delivery costs. The costs of delivery are priced accordingly on the website and are accurate as at the date we accept your order.

International delivery. If you wish for your items to be delivered internationally, please email info@stripeystork.org.uk for an estimated delivery cost. If your order has already been placed we will contact you via email. If we cannot contact you, we will be unable to dispatch your item. Orders that are shipped overseas may be subject to custom duties, and these are not included in the purchase price. As the buyer, you are responsible for these charges – unfortunately we have no control over them and cannot predict what they may be. Customs policies vary widely from country to country. If you’d like any further information, you should contact your local customs office.

You have the right to end the contract with us, and receive a refund, if the products are faulty or misdescribed.

You may be able to get a refund if you are within the 14 day ‘cooling-off period’, but please note that you may have to pay the costs of return of any products.

You may also end the contract if:
(a) we have told you about an upcoming change to the products or these terms which you do not agree to;
(b) we have told you about an error in the price or description of the products you have ordered and you do not wish to proceed;
(C) there is a risk that supply of the products may be significantly delayed because of events outside our control;
(d) we have suspended supply of the products for technical reasons, or notify you we are going to suspend them for technical reasons, in each case for a period of more than 30 days;
(e) there is something we have done wrong at law.

In these circumstances, we will pay for the cost of the return of the products via Royal Mail 1st Class for UK deliveries.

In addition, if after receiving your products you decide that you are unhappy or no longer want your products, please let us know in writing within 14 days of receiving the products. You must return the products to us at our address set out at the beginning of these terms. We will only accept returned item(s) if sent back to us in their original condition. If you wish to exchange your product(s) you can select different product(s) to the same amount or we can refund the difference.

If you wish to exchange a product, please note that the costs to return the item are non-refundable. If you simply change your mind and decide you no longer want your purchase; costs to return the item are non-refundable. If item(s) are damaged, faulty or there was an error upon dispatching we will refund the cost of posting.

You will receive notification via email of your refund. You can expect a refund in the same form of payment originally used for purchase.  We will refund you as soon as possible but in any event within 14 days of receipt by us of the returned products (subject to us confirming that they are in the original condition).

This does not affect your statutory rights.

The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality.

During the expected lifespan of your product, your legal rights entitle you to the following:

a) Up to 30 days: if your goods are faulty, then you can get an immediate refund.

b) Up to six months: if your goods can’t be repaired or replaced, then you’re entitled to a full refund, in most cases.

c) Up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.

These are subject to you returning the products to us.

When submitting your order you are agreeing to the purchase of products and to allowing Stripey Stork to use your personal data for the purpose of supplying the products. For further information on privacy and security please see Stripey Stork’s Privacy Policy.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products (including the right to receive products which are: as described and match information we provided to you and any sample or model seen or examined by you; of satisfactory quality; and fit for any particular purpose made known to us; supplied with reasonable skill and care); and for defective products under the Consumer Protection Act 1987.

We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose we will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure, loss of business opportunity or business interruption) or any other indirect or consequential loss even if the loss was reasonably foreseeable to both you and us when you commenced using the website or when the contract for the sale of goods was formed.

We reserve the right to make changes to our website, policies, and these Terms &Conditions of Sale at any time, however, such changes will not take effect until the completion of your order (if the changes are due to take effect after you place your order but before we accept your order). You will be subject to the Terms & Conditions of Sale at the time that you use the website or that you order products from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you).

We will not be held responsible for any delay or failure to comply with our obligations under these terms if the delay or failure arises from any cause which is beyond our reasonable control. This term does not affect your statutory rights (as set out above).

Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.

If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them (or any words within them) are unlawful, the remaining paragraphs (or words) will remain in full force and effect.

Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

These conditions are governed by and construed in accordance with the laws of the England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
